Dr. Shiva Ayyadurai Wins Historic Federal Lawsuit To Protect Your Free Speech
City of Cambridge Concedes That It Has No Right to Restrict the First Amendment
CAMBRIDGE, MA (May 17, 2018) – Today, Dr. Shiva Ayyadurai and the Shiva 4 Senate campaign team achieved a historic victory to protect your right to Free Speech. The City of Cambridge accepted to unconditionally withdraw its Enforcement Order, which sought to levy fines and other penalties on Dr. Shiva Ayyadurai for his campaign bus bearing the slogan, “Only a Real Indian Can Defeat the Fake Indian.” In a historic legal precedent, the City conceded that freedom of speech rights, embodied in the First Amendment, extend to all vehicles.
“If we had not fought and won this battle, the City of Cambridge would have set a historic precedent empowering any bureaucrat sitting in a City Hall across America to squelch your free speech, because they simply didn’t like you or favored a particular political ideology or candidate. Imagine being in constant fear that a slogan you put on your car, or on your body, such as a T-shirt, could result in your being dragged into court and fined? This is a victory for all Americans,” said Dr. Shiva Ayyadurai.
Dr. Shiva Ayyadurai has demonstrated that we the people can fight and win against City Hall. He will be issuing a formal statement today, Thursday, May 17, 2018, at 5:00 PM.
This battle began on April 22, 2018, when Dr. Shiva Ayyadurai and his campaign filed a lawsuit in Federal court, in response to the City of Cambridge’s April 5, 2018 Enforcement Order to levy a fine of $300 a day if Dr. Shiva Ayyadurai did not remove the campaign’s slogan, “Only a Real Indian Can Defeat the Fake Indian,” from its campaign bus.
On May 4, 2018, Dr. Shiva Ayyadurai directed his attorneys to file an additional Motion for Preliminary Injunction to force the City to cease and desist accrual of any and all fines, while the lawsuit was underway. That escalation forced the City to settle the lawsuit by agreeing to all of Dr. Shiva Ayyadurai’s terms. A full blown trial would have forced Elizabeth Warren to be the main subject of interrogatories, discovery, depositions and cross examination, likely revealing her role in colluding with officials in City Hall to squelch Dr. Shiva Ayyadurai’s rights to free speech.
“This victory is not just a victory for free speech but a victory for truthful free speech. Our slogan highlights Elizabeth Warren’s lack of integrity. She stole a Harvard faculty position meant for a real and deserving minority,” said Dr. Shiva Ayyadurai, who is running as an Independent, anti-Establishment candidate, in the 2018 election for U.S. Senate from Massachusetts.
Mike Mosca, a Campaign Manager for Shiva 4 Senate, who had first received harassing communications from Cambridge City Hall about the slogan, said, “Dr. Ayyadurai is the Real Deal, the Real Indian. He is the Real Fighter that America needs. He has consistently stood up for everyday Americans. This victory demonstrates that we the people can beat City Hall. His uncompromising stance forced the City to surrender. Had it been any other politician, first, they would never have even taken on this fight; and, second, they would have caved in to the City’s extortion.”
In August 2017, Dr. Shiva Ayyadurai was the Keynote Speaker at the Boston Free Speech Rally, which was falsely branded as a “Nazi” and “White Supremacist” event by Boston Mayor Marty Walsh and Massachusetts Governor Charlie Baker. At the Rally, Dr. Shiva Ayyadurai exposed the racism of Hillary Clinton, Joe Biden, Robert Byrd and Harry Reid, while his supporters held signs that said “Black Lives DO Matter,” “NO to Monsanto,” and “Real Jobs, Real Health.” The City of Boston, in consultation with the Southern Poverty Law Center, blocked Dr. Shiva Ayyadurai and his supporters from having access to the press and colluded with other groups to sabotage and misrepresent the event.
Dr. Shiva Ayyadurai has also faced the ire of the Establishment for speaking out against Monsanto, and defending academic free speech for those seeking to publish scientific results exposing the dangers of GMOs. In each of these cases, as in the case of the City of Cambridge, Dr. Shiva Ayyadurai did not back down, but fought back.
In the days leading to the end of the lawsuit, the negotiations became dramatic as the City attempted face-saving measures and imposed a fresh condition that Dr. Shiva Ayyadurai meet with a City official, who had an Indian sounding name, before they withdrew the Order imposing the fine.
This demand was rejected by Dr. Shiva Ayyadurai, who responded by asking his attorneys to escalate the fight with the Motion for Preliminary Injunction. “The City’s officials thought they could play out their habitual strategy of using a ‘house nigger’ to bring a ‘field nigger’ to heel, since they run the City like a plantation with slaves,” said Campaign Strategist, Arvind Kumar.
