VICTORY FOR THE PUBLIC: Historic 14-Page Federal Ruling Lays Bare the 501(c)(3) Media Scam

While Academic Hacks & Media Cronies Claim “Victory,” Our Lawsuit Forced the Federal Bench to Document the System of Exclusion by Design

The Non-Profit Media Syndicate SWARM: The Belmont Voice, the multi-paper syndicate, the money trail, the academic hacks and the establishment pollsters

This morning, the establishment media syndicate and its academic courtiers will scramble to pop champagne, print coordinated headlines, and declare a “victory” for their corrupt status quo.

Do not be deceived by the chorus of self-anointed “experts.”

Whenever an outsider exposes a rigged machine, the ruling class deploys its standard defense reflex: corporate lawyers celebrate procedural technicalities, tenured professors like Dan Kennedy rush to publish blog posts defending their cronies without reading primary court dockets, and corporate pollsters smugly nod along to protect their rigged sampling models. They want working people to look away, accept their gaslighting, and believe the fairy tale that a federal denial means the system is honest.

The truth is the exact opposite. We delivered a historic victory for the American public.

By dragging this machine into federal court, an unrepresented outsider forced an Article III judge and an elite corporate law firm (Davis Wright Tremaine) into full-scale legal combat—refusing to let them brush this off with a one-line dismissal. Instead, we forced the federal bench to write a sweeping 14-page evidentiary memorandum and order that puts the establishment’s entire playbook in black and white on the permanent public record: documenting how 501(c)(3) “charities” take tax-exempt dollars, coordinate multi-town syndicates for favored politicians, blacklist independent challengers, and hide behind corporate shields while judges admit the courts are powerless to stop them.

The “experts” didn’t win an exoneration; they secured a judicial confession that the racket is legally untouchable under current law.

We are fighting a war against a deeply entrenched, highly coordinated system of control I call The Swarm (ShatterTheSwarm.com). It is an incestuous network of establishment politicians, academic hacks, corporate pollsters, and fake “local” news outlets that work together to manipulate you, gatekeep information, and rig elections long before Election Day arrives.

Last week, we dragged one of the primary tentacles of this Swarm into the United States District Court for the District of Massachusetts.

The lawsuit is Ayyadurai v. Belmont News Foundation, Inc. et al. (Case No. 1:26-cv-14760-ADB). And while the defendants desperately tried to hide behind the First Amendment, what we actually exposed on the federal docket is a massive, systemic scam: The 501(c)(3) Local Media Racket.

Below is the definitive summary of how this tax-subsidized racket operates, how the academic enablers cover it up, how the federal ruling certified its mechanics, and the complete archive of our federal court filings—the receipts they cannot erase.

Step 1: The 501(c)(3) Tax-Exempt Scam

Here is how the establishment controls the narrative at the local level. They set up “community newspapers” like The Belmont Voice. They register with the IRS as 501(c)(3) public charities, allowing them to solicit tax-deductible donations, secure private foundation grants, and pay zero taxes.

To obtain that tax-exempt status under 26 U.S.C. § 501(c)(3), they sign a binding pledge to the IRS: they promise to operate as nonpartisan educational trusts, providing fair, equal coverage to all legally qualified candidates, and swear they will not intervene in any political campaign on behalf of or in opposition to any candidate for public office.

It is a complete lie.

Once they secure the funding, they operate as an exclusive, partisan public relations firm for the two-party Duopoly. They use your tax-subsidized dollars to platform establishment candidates while intentionally blacking out independent challengers who threaten the status quo. They harvest public charitable perks on the front end, while acting as an unaccountable, partisan private club on the back end.

Step 2: The Coordinated Blackout & The Delay Campaign

In August 2026, Belmont Voice editor Jesse Floyd explicitly promised in writing to cover our certified campaign for U.S. Senate. What followed was a 49-day campaign of bad-faith delay.

While they were stringing us along, demanding compliance and tone-policing a working-class Indian immigrant who holds four degrees from MIT, what were they doing behind closed doors?

They were coordinating with a six-paper regional syndicate (including Brookline.News and Cambridge Day) to organize an exclusive, pooled-resource video interview for the establishment Republican candidate, John Deaton. They gave Deaton an hour of uncritical PR, completely ignoring his self-published admissions of drug dealing, a shootout, and an adult relationship with a 15-year-old.

For our independent campaign? They stalled us through the start of early mail-in voting. When they finally sent four specific policy questions on October 14—which we answered fully—they refused to print them.

What was the Swarm’s open justification for this multi-week freeze-out? They told us in their own words. When we hit them with this federal lawsuit, the Belmont Voice Board of Directors released a public “Letter to Readers” trying to brush us off. Instead, they confessed on the record to the entire gatekeeping playbook:

“He is a candidate currently polling at 1 percent in an October 2026 Suffolk University poll sponsored by The Boston Globe. As such, The Voice had planned to include him in a story about independent candidates running for office…”

There it is. An official 501(c)(3) public charity openly admitting that it decides which certified federal candidates get solo, multi-paper video productions and which are relegated to delayed, buried group-story scraps based on private, establishment-funded poll data.

When we dragged them into Federal Court, they filed sworn declarations claiming they were just a “poor, small paper with a staff of three” that lacked the bandwidth to publish our four answers.

We destroyed that lie instantly. We submitted their own IRS Form 990 to the Court (Exhibit D). It proved they were sitting on $578,967 in net assets and a $213,825 net cash operating surplus. They had the money and the syndicate resources to platform the establishment; they just didn’t want the public to hear from an independent who challenges the system.

Step 3: The Academic Enablers & The Rigged Polling Machine

When the Swarm gets caught, they deploy their academic and institutional protectors to gaslight the public.

Enter Dan Kennedy, a journalism professor at Northeastern University. The moment our lawsuit hit the public docket, Kennedy rushed to his blog to defend his friends on The Belmont Voice’s board. In his own piece, Kennedy confessed:

“I have not immersed myself in the court documents.”

In what other scientific or academic discipline does a professor announce he hasn’t looked at the raw data or verified court record, and then proceed to lecture the public on the conclusions? He ignored the Form 990, ignored the 49-day email trail, and ignored the binding contractual promise. His job isn’t journalism—it is narrative protection for the media establishment.

Then look at how media syndicates manufacture justifications to exclude independent challengers: they cite corporate and university polls.

Gatekeepers like David Paleologos, Director of the Suffolk University Political Research Center, construct polling models designed from the ground up to protect the two-party status quo. Paleologos stated the quiet part out loud in an interview with The National Herald, laying bare the institutional contempt for anyone challenging the duopoly:

“Right now third party candidates are not viable to win, but they only make an impact by taking away votes from democrats and republicans.”

There it is in plain English. The establishment pollster openly declares from the outset that outside candidates “are not viable,” treating them merely as “spoilers” who siphon votes from their protected two-party cartel.

Suffolk University builds polling models that heavily weight major-party registrants and systematically under-sample unenrolled voters—who actually make up more than 60% of the Massachusetts electorate. By undervaluing independent campaigns in their sampling and then publishing a “1 percent” narrative, they hand local media the ultimate weapon.

The Board of The Belmont Voice then uses that exact “1 percent” tag to deny parity, block coverage, and string us along for 49 days while votes are being cast. On the far end, Northeastern professor Dan Kennedy publishes blog posts defending the lockout, openly admitting he hasn’t read the case files, and claiming it is all standard “editorial discretion” based on those same rigged numbers.

This is not a theory; it is a visible, cyclical machine:

  1. The Pollster creates restrictive sampling models that artificially suppress independent and third-party candidates.
  2. The Media Syndicate uses those suppressed percentages as an excuse to give solo feature platforms to the duopoly while blacking out challengers.
  3. The Academic Hacks step up to publish apologetics, calling political gatekeeping and broken agreements “press freedom.”

The pollsters engineer the suppression, the media uses it to silence dissent, and the academics provide the cover. That is the Swarm in action.

Step 4: The 14-Page Federal Ruling — The Racket Exposed in Black and White

On October 26, 2026, Judge Burroughs issued an initial 5-page Memorandum Opinion (ECF No. 25). Dan Kennedy and the defenders of The Belmont Voice immediately scrambled to broadcast that the court “dismissed the lawsuit.”

It was a deliberate lie designed to deceive readers who do not check primary sources. In Footnote 1, the Court explicitly confirmed that our First Amended Verified Complaint—anchoring the case in 42 U.S.C. § 1981 (prohibiting private racial discrimination in contracts) and 42 U.S.C. § 1985(3) (barring private conspiracies to interfere with federal election advocacy)—remained live, active, and before the bench.

Now, Judge Burroughs has issued her definitive 14-page Memorandum Opinion and Order on our renewed emergency motion.

Instead of burying the case, this 14-page ruling officially certifies how the legal and judicial system protects this racket:

THE 501(c)(3) MEDIA SCAM PLAYBOOK

  1. 1. Form 501(c)(3) NewsroomSolicit tax-deductible cash & public perks.
  2. 2. Pledge IRS NonpartisanshipSwear on paper not to intervene in elections.
  3. 3. Run Candidate BlackoutCoordinate multi-town syndicates for duopoly; freeze out independent challengers for 49 days.
  4. 4. Run Out The Election ClockSend last-minute token emails; stall past early voting.
  5. 5. Deploy Tornillo ShieldHide behind 1974 corporate press precedents when challenged in federal court.
  6. 6. The Impotent BenchCourt rules it lacks statutory power to intervene; IRS enforcement takes 3-5 years.ELECTION RIGGED BY DESIGN.

The ruling documents the exact mechanics:

  • Judicial Impotence Under Miami Herald v. Tornillo:
The court confirmed that under current First Amendment jurisprudence, federal judges believe they are legally powerless to enforce fairness against non-profit media. The court took Tornillo—a 1974 decision designed to protect private, commercial, for-profit newspapers—and stamped it onto a modern, subsidized 501(c)(3) entity.
  • Footnote 6:
On Page 11, Footnote 6, the court plainly states the harsh reality of current law: no federal statute or constitutional provision entitles a candidate to equal press coverage on any timeline.
  • Tone-Policing as an Institutional Weapon:
On Page 9, the court focused on our September 28 email calling out their bad faith, using our sharp language (“scumbags,” “blatant malevolence”) to justify the newspaper labeling our communications “aggressive.” The establishment completely ignores 49 days of syndicate election tampering, but clutches its pearls the moment an outsider refuses to speak in polite, subservient whispers.
  • The Structural Trap:
The IRS possesses sole regulatory authority over 501(c)(3) violations, but its complaint resolution process takes three to five years. Elections occur in weeks. By the time the IRS investigates, the ballots are certified, the establishment candidate is seated, and justice is permanently denied.

A System of Exclusion by Design: Shatter The Swarm

This federal ruling provides the receipts proving what we have said from day one: the system will not self-correct because it is ROTTEN TO THE CORE.

This mismatch between lightning-fast elections and glacial IRS enforcement is not an accident—it is a system of exclusion by design. The ruling class engineered this structure so that independent working-class candidates have zero legal recourse inside their courtrooms.

As your next U.S. Senator, I will lay this 14-page ruling on the Senate floor and introduce the Equal Access & Anti-Cartel Act:

  • Strip 501(c)(3) Status: Any non-profit newsroom that receives tax-exempt status must provide strictly equal airtime, column inches, and format parity to all ballot-qualified candidates.
  • Statutory Private Right of Action: Candidates must have direct authority to sue non-compliant 501(c)(3) organizations in federal court for immediate emergency injunctions during active election cycles.
  • Anti-Syndicate Penalties: Ban tax-subsidized newsrooms from pooling resources to create coordinated candidate monopolies across municipal borders.

Legislation alone cannot fix an entrenched oligarchy. A system this corrupt will never be reformed through courtroom appeals. It must be shattered by a bottom-up, non-justiciable movement of working people. When we organize outside their sandbox, reject their gatekeepers, and bypass their media syndicates entirely, power returns to the people.

The Court Archive: Read the Receipts

Do not take anyone’s word for it. Read the verified public record on the federal docket:

Take Action: File an Official IRS Referral

Under 26 U.S.C. § 501(c)(3), organizations receiving public tax exemptions are strictly prohibited from intervening in political campaigns. Nonpartisan education cannot serve as a cover for coordinated candidate favoritism.

Every email, text message, and internal communication regarding their September 24 syndicate meeting is under a mandatory federal litigation hold. While we take this fight to the political arena, hold them administratively accountable:

  1. Download IRS Form 13909 (Tax-Exempt Organization Complaint / Referral) at IRS.gov.
  2. Identify the Organization:
    • Organization Name: Belmont News Foundation, Inc. (d/b/a The Belmont Voice)
    • Address: PO Box 523, Belmont, MA 02478
(EIN and corporate details are available directly on Exhibit D above).
  3. Select the Violations: Check “Political campaign activity” and “Disparate/partisan candidate treatment.”
  4. State the Facts: Detail how this 501(c)(3) coordinated a multi-paper video interview syndicate for an establishment candidate while executing a 49-day blackout of a certified independent challenger, citing corporate poll data to justify unequal access.
  5. Attach the Receipts: Attach our First Amended Verified Complaint (ECF No. 22), Exhibit D (Form 990), and Judge Burroughs’ 14-page ruling.
  6. Submit: Email the completed package directly to eoclass@irs.gov or mail to:
